These terms apply to your use of TIDAL Property's websites, including tidalproperty.com, auction.tidalproperty.com, our project and information memorandum sites, and our hosted masterplan and meeting pages. By using them you agree to these terms.
1. Information only
Property information on our sites (including prices, sizes, plans, images, artist impressions, availability, dates and descriptions) is provided in good faith for general information. It's indicative only, may change without notice, and doesn't form part of any contract. It isn't financial, legal or tax advice. Before making any decision, rely on your own enquiries and professional advice, and on the contract and documents provided for the property.
2. Auctions
The Opportunity Auction and any other auction we run is conducted under the laws of Queensland or New South Wales, as applicable, and under the conditions of sale and auction for each property. Registering your interest on our website isn't the same as registering to bid: you must register as a bidder under the relevant law before bidding, and we'll explain how. We may withdraw, add or change properties, dates and venues.
3. Using our sites
Please don't misuse our sites. For example, don't use bots or scrapers to copy content or submit forms, don't try to break or overload our systems or bypass our security, don't submit false or someone else's details, and don't use the sites for anything unlawful.
4. Intellectual property
The content, design, logos, photography and software on our sites belong to TIDAL Property or our licensors. You may view and print pages for your own use in connection with a property, but you may not copy, republish or use them commercially without our permission.
5. Other websites
Links to other websites are provided for convenience. We aren't responsible for their content or practices.
6. Liability
To the extent permitted by law, we aren't liable for any loss arising from your use of, or reliance on, our sites or their content, or from them being unavailable. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded.
7. Privacy
We handle personal information as described in our Privacy Policy and Cookie Policy.
8. General
These terms are governed by the laws of Queensland, Australia. We may update them from time to time; the current version is always published here.
